October 2013: Breathalyzer Refusal; Driving Under the Influence

Police Report:

Client was followed one night by an off-duty officer,who noted the Client’s vehicle to be “all over the road”. After the officer contacted the Newport police department the client was observed running a stop sign, and was then pulled over by an on-duty officer. The officer notes that the Client smells strongly of alcohol,and has slurred speech and bloodshot eyes. The officer administers three field sobriety tests; and finds twelve empty beer cans in the car as well as a half-full bottle of vodka located in the center console.

Criminal Case Result:

  • Driving Under The Influence: REDUCED TO RECKLESS DRIVING WITH NO LOSS OF LICENSE
  • Breathalyzer Refusal: DISMISSED AWITH NO LOSS OF LICENSE
